So my question is: If a person [in a similar situation] had a gun and just picked up the gun .... not pointing the gun at the other person.... to show the other person that they had a gun, would this be against the law?

There is no brandishing law in Louisiana, hence the aggravated assault with a deadly weapon charge.

It has to do with intent.... Obviously her intent was to intimidate the other driver with the firearm which is considered assault. Assault is defined in RS 14:36 as "an attempt to commit a battery, or the intentional placing of another in reasonable apprehension of receiving a battery." The firearm made it a felony. I'd be willing to bet the guy in the car with her is the one that handed her the gun.
