Question for you lawyer people
 
Someone I know has had pneumonia 6 times this year... Her building is currently under construction and has asbestos in it..... Can this be a lawsuit ???
If its not worth it, what can be done ?? Just looking for info, no bashing

Worth checking in to. Even if others aren't getting sick, I'd say there's cause for alarm. I'd be very concerned. I am not a lawyer, but I did stay at a Holiday Inn Express.

If she doesn't have asbestosis, then likely, she needs to get a second doctor's opinion. In short, no cancer, no lawsuit.

I've worked in plenty of plants when asbestos abatement was taking place and never had pneumonia.

Asbestosis will not show up immediately, that's 30 years down the road, plus it will have nothing to do with pneumonia either.

Like you said dude no bashing, but you did mention her name on here and interest in a suit so you may want to find out for sure before you post something like that on a public forum. Hopefully I didn't ruffle any feathers but you don't want her to lose her job with a personal illness. Just friendly advice.

If advice is what you are seeking, find a new doctor. A lawyer will not make her feel any better.

If she has decent insurance then go to a few doctors to be checked and if they find somethin that can be traced back to office get a lawyer if company doesn't try to fix problem with building

I do wish I had some advice for you but like wtretrievers mentioned, it takes many years to detect.

Are they using asbestos to insulate or taking it out?

Once you know you have disease from asbestos it is usually advanced (or the person is dead). Typically asbestosis and/or mesothelioma (cancer from asbestos) do not manifest themselves until many years after exposure. By the time there is evidence for a lawsuit, it is typically too late for the person exposed.

Call OSHA, file complaint, have air samples taken by an Industrial Hygienist, have the air samples analyze.

Sounds more like mold exposure.

Abestos was taken out in the 70's, if they doing Asbestos abatement then the building would be shut down. I don't know if you seen this done but they cover all the windows, take of the AC system and when you everything must be taken out in sealed trash bags. You can't even come home in the clothes you work in, you have to wash your feet...etc. She would know if they were removing asbestos.

I would say its more of a mold problem than anything else. Or it could be that she is just sensitive to dust and what not.

I would look into mold and even more common, spores that cause these types of illnesses. Like said here in previous replies, when the BIG C word hits her, then she has problems. One thing to remember, we live in south LA with relative humidity consistantly over 90%, a haven for mold and such that cause upper respiratory issues. Upper respiratory issues going unchecked/untreated for long periods of time become lower respiratory issues - then pneumonia. Recurring sinus infections are the first sign of a problem.

That some bad stuff! I build scaffolds for asbestos removal. Totally inclosed with plastic and no one goes in with out the right PPE on and you have to have permits from the state to even remove it. Everything has to be washed down with certain chemicals before job is complete. They normally wet the asbestos before they remove it to keep it from becoming airborne.

It's a military building and they have done 2 abatements. They were sealed but the AC ducts are all in one. I don't think the abestos is getting me sick but the dust from the construction.
